Agreement Overview

This Boat Rental Agreement and Waiver is made between Monkey Mia Boat Hire (the “Owner”) and the undersigned individual(s) renting the boat (the “Renter”).

Definitions

• Renter: The individual(s) hiring the vessel from Monkey Mia Boat Hire.

• Owner: Monkey Mia Boat Hire, Shark Bay.

• Boat: Any vessel rented from the Owner.

Rental Period

• Rental begins and ends on the agreed dates and times specified in the booking.

Hours of Use

• Standard hire period allows up to 6 hours of vessel use per day.

• Use beyond 6 hours: $100 per additional hour, calculated from the onboard hour meter (ODO).

• Late returns: $75 per hour. Please notify us immediately to avoid unnecessary search-and-rescue notifications.

Rental Charges & Payment

• Full Day: $550

• 3+ Days: $530 per day

• 7+ Days: $500 per day

School Holidays & Long Weekend Policy
Monkey Mia Boat Hire Shark Bay is extremely busy during WA school holidays and long weekends. To keep things running smoothly and to give every family, FIFO worker, and traveller a fair chance to enjoy time on the water, we apply a 3-day minimum hire during these peak periods. This ensures we can deliver reliable service, fully maintained vessels, and a stress-free experience for everyone.  

MMBH will consider single day hire within 7days of the intended hire date, subject to availability.

Launch & Retrieval (subject to availability, arranged via phone):

• Denham: $75

• Monkey Mia: $150

• Nanga: $250

Payment Terms:

• 50% deposit required to confirm booking.

• Balance due before departure.

• Bond: $1,500 payable on day of hire (refundable upon safe return in good condition).

Fuel & Cleaning:

• Hirer must refuel before return. If not: $3 per litre + $100 admin fee.

• Vessel must be returned clean. If not: $120 cleaning fee.

Vessel Use

• Recreational use only.

• Only licensed operators with a valid WA Skippers Ticket (or equivalent).

• Operators must be listed on this agreement.

• Minimum age: 18 years.

• Day use only, within Shark Bay designated operating area.

• No operation in swells >2m or winds >22 knots.

Skipper’s Responsibility

• Responsible for passengers’ behaviour and safety.

• Ensure safety equipment is worn and instructions followed.

• Responsible for cleaning vessel before return.

Damage & Liability

• Hirer is responsible for all damage.

Propeller Damage: Fixed charge of $350 covering:

• Replacement prop: $250

• Delivery: $50

• Labour: $50

• Other damage (skeg, gearbox, motor, etc.) charged at actual cost.

• Costs deducted from bond or invoiced if bond insufficient.

• Faults:
  MMBH will endeavour to provide all vessels in the best working condition practicable.If a defect presents to a hirer, they are to cease operating and contact MMBH immediately and seek advice before continued use. Continued use of a vessel displaying an unknown defect without informing MMBH will be treated as negligent use.

Vessel Operation Rules

4A. Operating Area

• Vessel must remain within Shark Bay operational area.

• Taking vessel outside area without written consent = breach of contract and full liability for costs.

4B. GPS Tracking

• All vessels are GPS tracked.

• Location may be monitored for safety and compliance.

4C. Retrieval & Recovery Costs

If recovery is required due to negligence, abandonment, or breach:

• Steep Point: $2,500 + $4/km + $100 admin fee

• Dirk Hartog Island: $3,500 + $4/km + $100 admin fee

• Other Shark Bay areas: $1,500 + $4/km + $100 admin fee

Mooring & Vessel Recovery

Immediate forfeiture in full of any held bond, in addition to:

• Mooring requests must be emailed: [email protected]. Phone/verbal requests will not be accepted.

• Recovery costs include:

  • Recovery vessel: $1,500/day

  • Helicopter support: Up to $1,000/day

  • Additional associated costs (contractors, transport, fuel, accommodation, etc.)

Mooring Slippage:

• If a vessel slips its mooring, retrieval costs start at $1500 minimum, plus any additional recovery charges listed above.

By signing, hirer accepts full liability for recovery if required.

Safety & Emergency Procedures

• Children under 12 must wear lifejackets at all times.

• Radio use limited to emergencies or essential communication.

• Emergency contact: Monkey Mia Boat Hire or Shark Bay Marine Rescue.

Liability & Insurance

• Hirer is fully responsible for damages, injury, and third-party claims.

• Owner not liable for personal property or injuries.

• Vessel covered by full commercial insurance.

• Insurance excess: $1,500 payable by hirer per incident.

Cancellation & Refund Policy

Customer Cancellations

• 14+ days: Full refund or reschedule.

• 7–14 days: 50% refund or reschedule once.

• Less than 7 days: No refund (reschedule may be offered).

• No-shows or same-day cancellations: Full fee charged.

Weather Cancellations

• Unsafe conditions (winds >22 knots, swells >1.8m, severe warnings): Full refund or reschedule.

• Cyclone forecast within 48 hrs: Automatic cancellation with full refund.

• If customer cancels but conditions are deemed safe: No refund, standard terms apply.

Other Terms

• Refunds processed within 10 days, minus $100 admin fee.

• Medical/family emergencies considered case-by-case (supporting documents may be required).

Additional Terms

• Launch/retrieval subject to availability (arranged via phone).

• Hire refused if client is under influence of drugs/alcohol or behaviour is unsafe.

• Signed waiver required before hire.

• Hirer responsible for their own behaviour and crew’s conduct.

Right to Refuse Hire

Monkey Mia Boat Hire reserves full discretion to refuse hire if:

• Client appears intoxicated or under influence.

• Client cannot provide valid skipper’s ticket/ID.

• Behaviour, competence, or attitude is inadequate.

• Safety risk is identified.

Deposits may be forfeited.

Indemnity

Renter indemnifies Monkey Mia Boat Hire against all claims, losses, or liabilities from use of the vessel.

Governing Law

This agreement is governed by the laws of Western Australia.
